Gannon Ken Van Dyke allegedly spent $33,934 across Maduro-related @Polymarket contracts and walked away with $409,881 after helping plan the operation that captured him. Now his lawyers are seeking dismissal of the CFTC’s civil case. Their argument: • The contracts were geopolitical wagers, not regulated swaps • Event contracts like these fall outside the Commodity Exchange Act • The CFTC exceeded its authority with the anti-fraud rule used against him This is not only a dispute over whether Van Dyke possessed classified information. It is a direct challenge to whether the CFTC has jurisdiction over prediction markets like Polymarket in the first place. Van Dyke still separately faces a criminal case involving alleged theft of government information, commodities fraud, wire fraud and an unlawful monetary transaction. But the civil case now comes down to a much bigger question. Not whether he knew the future. Whether the market he traded was legally a financial instrument at all.
