Senator Thom Tillis, a Republican from North Carolina, stated that due to the delay until September, the likelihood of the bill ultimately passing may have decreased by 50%. Senator Cynthia Lummis, a Republican from Wyoming leading the negotiations, noted that discussions have been ongoing for nearly 11 months, with the bill text expanded by approximately 300 pages and incorporating numerous amendments requested by Democrats, and that it is now time to proceed to a vote. The Democratic Party still opposes the current version, primarily due to disagreements over provisions limiting government officials’ interests in crypto assets. Democrats argue that the current version does not sufficiently restrict federal officials from investing in or promoting crypto assets, nor does it require them to fully divest their holdings, and they seek to grant state attorneys general stronger enforcement powers. Some Democratic and Republican lawmakers previously pushed for stricter ethics regulations, but negotiations continue. Democrats are particularly focused on potential conflicts of interest involving Donald Trump and his family with crypto projects such as World Liberty Financial. Previously, the crypto industry had hoped the Senate would advance procedural votes before the summer recess to allow adjustments to political spending during the 2026 midterm elections. Data shows that Fairshake, the primary political action committee for the crypto industry, began this cycle with nearly $200 million in cash reserves.
