Ripple Has a Path Forward Even Without the CLARITY Act

Top crypto researcher SMOKE argues that Ripple does not have to wait for the CLARITY Act to advance its institutional ambitions. With the bill facing another delay in the U.S. Senate, the argument is gaining traction: regulatory uncertainty may slow parts of crypto adoption, but it does not have to stop Ripple from building.

The CLARITY Act could establish a broader regulatory framework for digital assets, including clearer rules on token classification and federal oversight. Nevertheless, it is not the only route to greater regulatory legitimacy.

Ripple’s national trust bank charter from the Office of the Comptroller of the Currency (OCC) offers another path. The OCC conditionally approved Ripple National Trust Bank’s application in December 2025, putting the company on a path toward operating within the federal banking regulatory framework.

Well, this could be significant for Ripple since a federally supervised banking structure could strengthen the company’s position with financial institutions and regulated businesses, particularly across custody, stablecoin operations and RLUSD reserve management.

SMOKE’s argument is straightforward because if Congress continues to struggle with the CLARITY Act, the OCC charter could provide Ripple with an important avenue for strengthening its federal regulatory standing.

However, there is an important distinction. The OCC approval is conditional and does not mean Ripple is already operating as a fully established national bank. Nor can the charter replace the market-wide regulatory clarity that federal legislation could provide.

More notably, the two paths could instead complement each other.

Ripple’s Alternative Path Beyond the CLARITY Act

The CLARITY Act would establish rules for the broader U.S. digital-asset industry, while the OCC charter provides Ripple with a company-specific regulatory pathway. If both advance, Ripple could potentially benefit from broader legislative clarity alongside its own regulated banking infrastructure.

Interestingly, the SEC is exploring new approaches to crypto regulation and lawmakers prepare to revisit the CLARITY Act after the August recess. With attention now shifting toward September, uncertainty over the bill’s prospects remains.

For XRP, the bigger takeaway is that adoption does not necessarily have to wait for Congress.

Ripple can continue expanding across payments, institutional custody, stablecoins, tokenization and cross-border settlement. As its regulated infrastructure grows, those efforts could create new opportunities for XRP and the XRP Ledger.

The bullish argument, therefore, is not that Ripple does not need the CLARITY Act. It is that Ripple has another path forward if the legislation stalls.

If the CLARITY Act eventually passes, Ripple could potentially benefit from both a clearer federal crypto framework and its own regulated banking infrastructure. Until then, the company can keep building, and XRP adoption does not necessarily have to stand still.
