Former SEC legal advisor Ashley Ebersole outlined key crypto compliance hurdles for real-world assets (RWAs), stressing that regulatory engagement—not technology—has been the main bottleneck. Ebersole, who worked at the SEC from 2015, noted that enforcement-heavy policies from 2017 to 2019 slowed RWA progress. Post-2021, communication between the SEC and crypto firms dropped, but recent leadership shifts, including Paul Atkins’ appointment, have improved openness. He proposed a compliant token model similar to depositary receipts and warned of jurisdictional and revenue-related challenges, including Countering the Financing of Terrorism concerns. Despite these issues, RWA tokenization is gaining traction, with Robinhood, BlackRock, and JPMorgan entering the space.
