Odaily Planet Daily reports that, according to three informed sources, the White House has reviewed potential candidates for four vacant seats on the CFTC, but it remains uncertain when or if formal nominations will be made. Currently, the CFTC has only one commissioner, Chairman Michael Selig, whereas the agency typically consists of five bipartisan commissioners.
Vacancies on the commission have become a point of contention in CLARITY Act negotiations. Democratic lawmakers argue that both agencies have critical vacancies at a time when the bill seeks to expand and delineate the regulatory jurisdictions of the SEC and CFTC over digital assets. The Senate is expected to hold a key procedural vote on the CLARITY Act on September 15; sources say that the White House’s commitment to filling the CFTC vacancies may be a condition for securing Democratic support. Even if the bill advances in the Senate, legislative progress may still be delayed until the lame-duck session after the November elections due to the congressional fall schedule and midterm election timelines.
