X's lawsuit against Terry Harwood for generating illegal CSAM is a very creative legal strategy. It serves to position models as an open tool rather than a discretionary product. I think the best way to create a policy distraction is for these foundation model companies to somehow deliver on a bounty or a private right of action to outsource the enforcement of TOS violations to third party firms and citizens.
