The real issue is the distinction between parallel conduct and actual coordination. For OPENAI, $SPCX, $GOOGL and Anthropic, the key question is whether there was an actual agreement that constrained competitive behavior around model releases, compute deployment or frontier development, rather than simply similar public views on AI safety. The statements alone don’t establish that. The evidentiary trail showing coordination between competitors is what could make the antitrust argument materially stronger.
