The $CFTC just told CME its own volume data undercuts the lawsuit. The brief argues CME hasn't shown imminent harm from the perpetual-futures policy, and notes CME's crypto-futures volume actually rose after the shift. That is a hard fact for CME to argue around: the venue suing over the policy is the same venue printing more volume under it. What this changes for positioning: the legal overhang on U.S. perps gets pushed out, not removed. Kalshi's first bitcoin perpetual cleared in May, and that product stays live while the court works through whether perps are futures or swaps. The regulatory question is unresolved. The access question is not. So the structural read is a slow bid for regulated perp venues and the liquidity that follows them, with a cap on how far anyone sizes into it until the futures-versus-swaps classification is settled. That classification decides margin, reporting, and which desks can touch the product at all. Until it lands, expect perp basis on U.S. venues to trade at a discount to offshore, and expect that gap to compress fast on any favorable ruling. Watch the next court date and any CME filing that responds to the volume point directly. If CME pivots from harm to classification, the fight moves from access to structure, and that is the one that reprices the whole perp complex.
