Note from the distinguished Senator from NJ: Dear Mr. Xxxx Thank you for taking the time to write to me about digital asset market structure legislation. I rely on the input of engaged New Jerseyans like you when making decisions, and I appreciate you sharing your thoughts. Digital assets and blockchain technology have the potential to strengthen the American economy if supported with clear rules and appropriate guardrails. According to a Federal Reserve study, in 2023, 18 million Americans engaged with digital assets whether for payments, savings, or participating in financial markets. The United States has been a leader in this rapidly developing field, and we must ensure we maintain our competitive edge on the world stage by closing regulatory gaps.  As a member of the Senate Agricultural Committee and Ranking Member of the Subcommittee on Commodities, Derivatives, Risk Management, and Trade, I have long worked in a bipartisan manner to advance thoughtful oversight and legislation to help this emerging market. In 2022, I introduced the Digital Commodities Consumer Protection Act alongside then-Senator Debbie Stabenow (D-MI), Senator John Boozman (R-AR), and Senator John Thune (R-SD). The bill would have given the Commodity Futures Trading Commission (CFTC) primary authority over digital commodity transactions and set basic rules for how exchanges must operate and protect consumers.  On November 10, 2025, I worked with the Senate Agriculture Committee Chairman John Bozeman (R-AR) to release a bipartisan discussion draft of the digital asset market structure legislation. The draft would have expanded the CFTC’s authority to oversee trading platforms and intermediaries, creating certainty for builders, innovators, and investors operating in the digital asset market. Additionally, it established strong consumer protections and guardrails to ensure a fair and competitive market. Unfortunately, on January 29, 2026, the Committee introduced and passed a new, partisan bill, the Digital Commodity Intermediaries Act (S.3755), by a party-line vote of 12–11.  In the evolving sphere of cryptocurrency, it is critical to find the right balance between competition in the marketplace, consumer protection, and creating certainty for innovators. I recognize the complexity of establishing fair market structure rules and am committed to working with my colleagues in a bipartisan manner to create clear rules of the road. Please know that I will continue working across the aisle to advance legislation forward that establishes clear rules of the road, protects consumers, cracks down on bad actors, and can ultimately be signed into law.  Again, thank you for writing to me. I am honored to represent you in the United State Senate, and I value what I hear from New Jerseyans about the issues our state and nation face. Please continue to keep in touch with your thoughts and concerns. For more information on my work in New Jersey and in Washington, please visit my website at https://t.co/4GChuOL6fw.
