KuCoin Bot – Terms of Service
By using, submitting a query to the KuCoin Bot (the “Service”), you confirm that you have read, understood and agreed to the following terms (“Terms of Service”). Please read these Terms of Service carefully before proceeding.
These Terms of Service governs your use of the artificial intelligence tool (“KuCoin Bot”) and are supplemental to, and shall be read together with, the Platform Terms of Use (“Terms of Use”). All other provisions in the Terms of Use not modified by these Terms of Service shall remain in full force and effect. In the event of any conflict or inconsistency between these Terms of Service and the Terms of Use, these Terms of Service shall prevail in respect to the Service, unless expressly stated otherwise.
Unless otherwise defined, capitalized words used in these Terms of Service shall have the same meaning given to them in the Terms of Use. The rules of interpretation set out in the Terms of Use shall apply to these Terms of Service.
The Platform reserves the right to unilaterally modify these Terms of Service at any time. If any changes are made, the revised Terms of Service may be posted on the Platform’s website. Your continued use of or access to the Service constitutes your acknowledgement, understanding, and unconditional acceptance of and agreement to be bound by the revised Terms of Service. If you do not agree to the revised Terms of Service, you must immediately cease using the Service.
Nature of the Service
The Service is an artificial intelligence tool designed to provide:
(1) information regarding the products and/or services offered on the Platform from time to time;
(2) support for users in performing administrative tasks such as executing any selling, purchasing, transfer or entering into any other types of transaction involving digital assets (“Transactions”) permitted on the Platform from time to time; and
(3) general information, insights, or recommendations based on the prompts you supply.
The Platform reserves the right to improve, modify, suspend, or discontinue the Service at any time without prior notice.
Disclaimer
Acknowledgement of Risk - You expressly acknowledge and agree that the Service utilizes artificial intelligence to generate content (“Outputs”). Due to the inherent limitations of this technology, the Outputs may be inaccurate, incomplete, misleading, outdated or erroneous.
No Warranty - The Service and any Outputs are provided on an “as-is” and “as-available” basis. You acknowledge that the Outputs are generated by an automated system and may contain errors or inaccuracies, and you agree that the Platform makes no warranties of any kind, whether express or implied, regarding the accuracy, completeness, reliability, suitability, or timeliness of any Outputs.
Verification is Your Sole Responsibility - You are solely liable and responsible for any use of, or reliance on, the Outputs, whether directly or indirectly. Before acting upon or making any decisions based on any Output (including, but not limited to financial, legal or technical decisions), you have an independent duty to verify the Outputs.
Exclusion of Liability - To the fullest extent permitted by law, in no event shall the Platform, its affiliates, directors, officers, employees, agents, or partners be liable for any direct, indirect, incidental, special, punitive, or consequential damages – including, but not limited to loss of profits, loss of data, business interruption, or reputational harm – arising out of or in connection with the use of, or inability to use, the Service or any Outputs, whether based on contract, tort (including negligence), or any other legal theory, and whether or not the Platform have been advised of the possibility of such damage.
Purpose of Outputs - The Outputs are provided solely for general information and educational purposes only and do not represent the Platform’s view. It is not intended to be an endorsement or solicitation, and do not constitute financial, legal, investment, or professional advice to buy or sell digital assets. You should not rely on the Outputs as a substitute for independent professional judgment.
Risks of Investing in Digital Assets - The investment of digital assets involves an extremely high level of risk. You should carefully evaluate your investment decisions and obtain independent professional advice before proceeding. The Platform accepts no responsibility for any actions taken, or not taken, in reliance on the Outputs.
Information from Third Parties - To the extent that any Outputs are derived from information provided by third parties, they are subject to their own terms, and we are not responsible for them. It doesn’t mean the third party endorses or is affiliated with the Platform. We also do not guarantee that the information from the third parties is accurate, complete, or up-to-date.
Inputs and Grant of License
Grant of License - In order to operate, maintain, and improve the Service, you hereby grant the Platform a worldwide, non-exclusive, royalty-free, sublicensable, perpetual, and irrevocable license to use, host, store, reproduce, modify, create derivative works from (such as those resulting from translations, adaptations, or other changes), communicate, publish, publicly perform, publicly display, and distribute any data, prompts, text, or other materials you provide to the Service ("Inputs").
Right to Use for Model Training - You expressly agree that the license granted above includes, but not limited to our right to use your Inputs (typically on an aggregated and de-identified basis) for the purposes of training, developing, and improving our artificial intelligence models and related products and services.
No Obligation of Confidentiality - Do not submit any information that you consider to be confidential or proprietary through the Service. Unless otherwise agreed in a separate written agreement, or as required by applicable mandatory law, we assume no obligation of confidentiality with respect to your Inputs. While we try to make sure that the Service is secure, we do not actively monitor or check whether information supplied to us through Service is confidential or commercially sensitive. We are not responsible for protecting any confidential or proprietary information you provide to the Service.
Data Privacy
Do not submit any personal or sensitive information unless required for us to assist you. Any personal information you provide will be handled in accordance with our Privacy Policy. Except for personal information protected under our Privacy Policy, Inputs may be treated as non-confidential and used by us for training, developing, and improving our artificial intelligence models and related products and services.
Limitations and User Responsibilities
Limitations of the Service - We strive to ensure that the Service is accurate, current, and reliable. However, we cannot guarantee that it will always be free from bugs or up to date. Further, we make no assurances that the Service will meet your specific needs or be suitable for any particular purpose. Any reliance on the information provided by the Service is entirely at your own discretion and risk.
User Responsibilities - By using the Service, you acknowledge and agree that you shall:
(1) refrain from using the Service in any manner that contravenes applicable laws and regulations;
(2) be solely responsible for any and all costs and expenses incurred in connection with your use of the Service;
(3) not send, share or publish any discriminatory, defamatory, offensive, intimidating, illegal, racist, obscene or inappropriate content in any form through the Service;
(4) not use the Service for the purpose of engaging in any unlawful, fraudulent, or immoral activities;
(5) not attempt to manipulate or exploit the Service into producing harmful, abusive or misleading Outputs;
(6) refrain from using the Service in any manner that infringes, misappropriates, or otherwise violates the intellectual property or proprietary rights of third parties;
(7) not interfere with or disrupting the Service, including bypassing any protective measures or safety mitigations;
(8) not attempt or assist anyone to reverse engineer, decompile or discover the source code or underlying components of the Service, including our models, algorithms, or systems.
We reserve the right to, restrict, suspend or terminate your access to Service where it is being used in an inappropriate manner or in breach of these Terms.
Ownership and Intellectual Property
Ownership of the Service - All rights, title, and interest in and to the Service, including its underlying technology, software, components and Intellectual Property Rights (including, but not limited to, trademark rights, patent rights, copyrights, trade secrets and all other intellectual property rights of any kind), excluding user-provided Inputs, are and will remain the exclusive property of the Platform.
Assignment of Outputs - Subject to your compliance to these Terms of Service, and to the extent permitted by the applicable law, we hereby grant you a world-wide, royalty-free, non-exclusive license (or, where applicable, assign to you all right, title and interest, if any), in and to Outputs generated by the Service for you. You accept this license/assignment on the condition that you are solely responsible and liable for your use of the Outputs, including for ensuring that such use does not infringe any third-party rights or violate any applicable laws.
Suspension and Termination
We may restrict, suspend or terminate access to the Service at any time at our sole discretion, including, but not limited to, where we reasonably believe there has been misuse, breach of these Terms of Service, technical issues or to comply with the applicable laws and regulations. You acknowledge that the Platform shall not be liable for any damage, loss, claim, liability or consequence arising out of or in connection with such restriction, suspension or termination.
Governing Law
These Terms of Service are governed by the laws of Turks and Caicos Islands. Any disputes will be resolved in accordance with the dispute resolution provisions of the Terms of Use.
Interpretation of Terms
The ultimate power to interpret this Terms of Service shall be vested in the Platform.
